Backyard sheds can provide much needed storage space, but all accessory structures should meet minimum standards pertaining to size, location, and maintenance. Please observe the following guidelines to ensure compliance with your accessory structure.
Permits are required for all accessory structures over 200 square feet in area. All accessory structures over 200 square feet must be built to standards established in the MN State Building Code, and suitably anchored to the ground. Follow the link below for a building permit application for an accessory structure over 200 square feet. Temporary structures such as carports are prohibited.
Accessory structures should meet applicable setbacks and be located in the side or rear yard. Structures under 144 square feet should not be closer than 5 feet to rear property lines and structures over 144 square feet should not be closer than 10 feet to the rear property line. Regardless of size accessory structures should be kept 5 feet from any side lot property lines and 20 feet from a side lot line when adjacent to a public right of way. Please contact the City of Apple Valley Planning Department at (952) 953-2575 to discuss the placement of your accessory building.
Location in utility easements of record is prohibited without consent of the city and/or the public utility holding the easement. All accessory structures must be adequately maintained so as not to be an eyesore or a public nuisance.
With questions or concerns regarding compliance of existing accessory structures in your neighborhood please contact Code Enforcement by phone at 952.953.2571; or by email at codeenforce@ci.apple-valley.mn.us.
